Pero más allá de la pretensión de legitimar las sanciones con teorías que indican sus finalidades, los penalistas intentan definir prácticas de perdón, creando hipótesis dentro de las cuales el Estado puede dejar de castigar.

ArgumentThis paper analyzes the research strategies of three different cases in the study of human genetics in Mexico – the work of Rubén Lisker in the 1960s, INMEGEN's mapping of Mexican genomic diversity between 2004 and 2009, and the analysis of Native American variation by Andrés Moreno and his colleagues in contemporary research. We make a distinction between an approach that incorporates multiple disciplinary resources into sampling design and interpretation (unpacking), from one that privileges pragmatic considerations over more robust multidisciplinary (...) analysis (flattening). These choices have consequences for social, demographic, and biomedical practices, and also for accounts of genetic variation in human populations. While the former strategyunpacksfine-grained genetic variation – favoring precision and realism, the latter tends toflattenindividual differences and historical depth in lieu of generalization. Bullying of people with Special Educational Needs with or without disabilities is a reality, being one of the most affected groups. This study presents the data obtained in a European Erasmus+ project in which 96 young people and adults with SEN/D from four countries participated: Ireland, Spain, Italy, and Portugal. Firstly, a questionnaire was passed to see the general knowledge of these people in relation to bullying. Then a training program was carried out and finally the questionnaire was passed again (...) to see if the data improved. From the data it appears that people with SEN/D lack skills, knowledge, and resources to deal with bullying. After the completion of the training program the data obtained from the questionnaire improved in many respects. Sometimes people with SEN/D are not aware that they are suffering from this type of situation due to lack of knowledge, so it is necessary to continue implementing training programs to help improve this situation. RESUMO Com base na noção de currículo como uma arena de embates discursivos, este artigo tem por objetivo principal analisar de que modo a Base Nacional Comum Curricular de Língua Portuguesa e Literaturas compreende os conceitos de fruição e de leitor-fruidor. Com efeito, é nossa intenção compreender como a ideia de leitura literária é proposta por esse documento oficial curricular. Para tanto, as habilidades e conteúdos indicados pela Base Nacional Comum Curricular foram analisados a partir de uma perspectiva metodológica interpretativista (...) e sob a perspectiva dialógica de análise do discurso desenvolvida pelo Círculo de Bakhtin. ABSTRACT Based on the notion of curriculum as an arena of discursive clashes, this paper aims at verifying how the Base Nacional Comum Curricular [Common Core] for Portuguese Language and Literature understands the concepts of fruition and reader-in-fruition. Indeed, it is our intention to understand the very idea of literary reading proposed by this official curriculum document. For this purpose, the skills and contents indicated by BNCC were analyzed from an interpretive research methodology view and under the dialogic perspective for discourse analysis developed by the Bakhtin Circle. The Creative Citizenship project was founded to promote critical, ethical, and creative thinking in early childhood, and to recognize and encourage children as social actors and peacebuilders. In concert with the methodology of North American philosopher Matthew Lipman's Philosophy for Children (P4C), Creative Citizenship seeks to promote in children the ability to think critically, ethically, and creatively in and from their own realities, and to exercise multidimensional thinking skills in the various areas of their daily lives. The research documented here (...) adopted a qualitative approach in so far as it sought to inquire about the character of those relationships, particularly among boys and girls, that promote their identity as social agents. As such, it examined training processes and generated theoretical perspectives in the interest of promoting social transformation through the empowerment of multidimensional thinking. The article begins with a review of the concept of Creative Citizenship and ends with that of Peacebuilding. Three theoretical categories have been applied in order to situate the inquiry within the framework of the realities of childhood, and to chart the pedagogical interventions by adults that occurred throughout the implementation of the project. The first focuses on the development of children’s thinking per se, the second on children's capacities for creative problem-solving in social environments, and the third on the concept of peacebuilding as a commitment to practicing philosophical dialogue among children, which is understood as a form of discourse that builds the capacities of citizens to undertake individual and collective actions that allow them, in turn, to create and re-create scenarios of peaceful coexistence. En este artículo se presenta un análisis crítico de la novela El amor en los tiempos del cólera, del escritor colombiano Gabriel García Márquez, basado en las categorías o aspectos que propician la narración de los acontecimientos pasados. A partir de la hipótesis de que la obra constituye una evocación del pasado o, en otras palabras, un viaje a los recuerdos, se analizan los siguientes aspectos con el fin de determinar cómo la narración de las experiencias se construye (...) a partir de ellos: la narración, que incluye al narrador y las técnicas narrativas; los detonadores gracias a los cuales se efectúa la rememoración; el contexto cotidiano en el que se introducen; la representación del tiempo y del espacio y las relaciones entre los personajes. Crisis requires society to renew itself, albeit in a disruptive way. The current Covid-19 pandemic is transforming ways of working, living, and relating to each other on a global level, suddenly and dramatically. This paper focuses on the field of education to show how higher education institutions are undergoing radical transformations driven by the need to digitalize education and training processes in record time with academics who lack innate technological capabilities for online teaching. The university system must strive to overcome (...) this situation to be competitive and provide high-quality education in a scenario of digital transformation, disruptive technological innovations, and accelerated change. To achieve these goals, this paper explains some barriers and challenges that universities encounter, as well as technological resources and methodologies they have used in the current scenario to transform higher education to face Covid-19 disruption. The discussion and conclusion synthesize significant insights that can be applied to the digitalization of education in the foreseeable future. (shrink)

Hemos querido realizar un acercamiento propio a partir de las obras de santo Tomás de Aquino propuestas en el título.

The aim of the article is to formulate a proposal for the conceptual analysis of the notion of predictability of law, in order to make clear its theoretical and practical implications. To achieve this goal, I will explain the theoretical (what conceptual implications it has) and practical (what decisions it requires us to make) commitments that this conceptualization requires. Specifically, I analyze the commitments to the types of receivers of predictions and issuers of predictions; then I identify what kinds of (...) relationship can be assumed between the predictability of law and its effectiveness; next I indicate what the use of predictions as a means of assessing the degree of satisfaction of legal certainty commits us. Finally I indicate what commitments must be made in adopting a methodology for making predictions. (shrink)

This study explores the capacity of Artificial Intelligence (AI) to revolutionize educational pedagogy, aiming to foster a more personalized and effective learning experience. Methodology: Through a bibliometric analysis of publications in Scopus and Web of Science, the research examines AI's impact on adaptive learning, personalized instruction, and effective teaching methods. It also evaluates AI's role in assessment, creation of simulated learning environments, and widening access to education, while addressing the integration challenges. Conclusions: The investigation demonstrates that AI has considerable potential (...) to improve teaching and learning. AI-driven tools like intelligent tutoring systems, machine learning algorithms, and virtual simulations can facilitate a learner-centric approach. Nonetheless, it also highlights the necessity to confront issues such as technological overdependence, privacy concerns, and the potential displacement of teachers. A thoughtful adoption of AI in education could lead to a more equitable and engaging learning system. The advent of this educational revolution demands a focus on augmenting human capabilities with AI and transforming pedagogical strategies to enhance student outcomes. In recent years, supported by new scientific evidence, the conceptualization of cognitive reserve has been progressively enriched and now encompasses not only cognitive stimulating activities or educational level, but also lifestyle activities, such as leisure physical activity and socialization. In this context, there is increasing interest in understanding the role of psychological factors in brain health and cognitive functioning. In a previous study, we have found that these factors mediated the relationship between CR and self-reported cognitive functioning. In this study, (...) we have confirmed an association between two important constructs included in the psychological wellbeing and salutogenic models, “purpose in life” and “sense of coherence,” CR, as assessed using a questionnaire, and cognitive functioning, as evaluated using a comprehensive neuropsychological battery. Results from 888 middle-aged healthy participants from the Barcelona Brain Health Initiative indicate that both sense of coherence and CR were positively associated with verbal memory, reasoning and attention, working memory, and global cognition. Moreover, the relation between CR and cognitive functioning in the different domains is partially mediated by SoC. When we controlled for brain integrity, introducing into the model neurofilament light chain measures, the mediator role of SoC was confirmed for reasoning and attention and global cognition. However, purpose in life was not associated with cognitive functioning. These results reveal the central role of the SoC construct, which mediates the association between classic CR estimates and cognitive functions, potentially representing a modifiable target for interventions that aim to promote brain health. University students will be our future business leaders, and will have to address social problems caused by business by implementing solutions such as social entrepreneurship ventures. In order to facilitate the learning process that will foster social entrepreneurship, however, a more holistic pedagogy is needed. Based on learning theory, we propose that students’ social entrepreneurship actions will depend on their learning about CSR and their absorptive capacity. We propose that instructors and higher education institutions can enhance this absorptive capacity by (...) exploiting Web 2.0 technologies. We tested our proposition with a sample of 425 university students using structural equation modeling and found support for the proposed relationships. (shrink)

La visión del τόπος ὑπερουράνιος en el Fedro se describe a partir de tres contenidos: la justicia, la sensatez y la ciencia. Solamente de esta última se brinda una mayor precisión. En “‘Der Geistcharakter des Überhimmlischen Raumes’. Zur Korrektur der herrschenden Auffassung von Phaidros 247c-e”, W. Schwabe mostró que este pasaje distingue necesariamente la ciencia “en lo que es” de la ciencia “en lo que ahora denominamos seres”, y que esta última remite a la ciencia como práctica humana de adquisición (...) y transmisión de conocimiento. Luego de revisar sus principales argumentos, examinaré esta distinción en el diálogo completo, especialmente respecto de la ciencia “en lo que ahora denominamos seres”, en dos momentos: 1) el resultado de la visión de la ciencia como memoria, μνήμη, cuando el alma regresa al ámbito sensible, así como su recuperación en la relación erótica y 2) la forma como se relacionan memoria y ciencia en la transmisión del conocimiento, en la crítica de la escritura. La identificación de la ciencia con la “semilla inmortal” contenida en los discursos del dialéctico se vinculará al análisis de la procreación en la belleza en el Banquete y se mostrará que la ἐπιστήμη, en tanto contenido de los λόγοι, expresa la relación dinámica entre las ideas. La diferencia entre la “ciencia en sí” y la “ciencia en nosotros” exige, por tanto, concebirla como un “rasgo estructural” del ámbito eidético, del mismo modo que la justicia en la República y, cabe suponer, la sensatez. This paper aims to analyze Diotima’s definition of eros as a desire to beget and give birth in beauty. The main problem lies in the use of the notions of kuêsis, tokos, genesis and gennêsis. We will distinguish the meanings of each term and show that the erotic relationship is focused on the preservation of that which the lover already carries within himself. On this basis, and by using some passages from the Phaedrus, we seek, finally, to explain why science (...) belongs to the realm of generation. (shrink)

Jean-Jacques Rousseau’s passion for nature is well known. Less known is the fact that Rousseau devoted himself to the study of botany in the last years of his life. This article investigates how the themes of denaturation and monstrosity - classical themes of Rousseau’s thought - appear in his reflections on plants and the vegetal kingdom. After a brief incursion into the second Discourse and Émile, we will focus on the analysis of the so-called Elementary Letters on Botany, sent to (...) Madeleine-Catherine Delessert, and the letters sent to the Duchess of Portland. In the first set of letters we find Rousseau’s views on double flowers and grafting. In the second set of letters, in turn, we find Rousseau’s views on gardens and the cultivation of exotic plants. Since Rousseau’s reflections on denaturation are entirely due to his reading of Buffon, the article also addresses the contributions of this author. We conclude with some reflections on the current state of our teratological tendency, well identified by the authors we discussed throughout the text. (shrink)

Recent neuroscientific evidence brings into question the conclusion that all aspects of consciousness are gone in patients who have descended into a persistent vegetative state (PVS). Here we summarize the evidence from human brain imaging as well as neurological damage in animals and humans suggesting that some form of consciousness can survive brain damage that commonly causes PVS. We also raise the issue that neuroscientific evidence indicates that raw emotional feelings (primary-process affects) can exist without any cognitive awareness of those (...) feelings. Likewise, the basic brain mechanisms for thirst and hunger exist in brain regions typically not damaged by PVS. If affective feelings can exist without cognitive awareness of those feelings, then it is possible that the instinctual emotional actions and pain "reflexes" often exhibited by PVS patients may indicate some level of mentality remaining in PVS patients. Indeed, it is possible such raw affective feelings are intensified when PVS patients are removed from life-supports. They may still experience a variety of primary-process affective states that could constitute forms of suffering. If so, withdrawal of life-support may violate the principle of nonmaleficence and be tantamount to inflicting inadvertent "cruel and unusual punishment" on patients whose potential distress, during the process of dying, needs to be considered in ethical decision-making about how such individuals should be treated, especially when their lives are ended by termination of life-supports. Medical wisdom may dictate the use of more rapid pharmacological forms of euthanasia that minimize distress than the de facto euthanasia of life-support termination that may lead to excruciating feelings of pure thirst and other negative affective feelings in the absence of any reflective awareness. Bajo el concepto común de gamificación existe un complejo mundo dentro del cual existen distintas opciones, cada una con su denominación, que para quien se adentra por primera vez en él pueden generar confusión. Cada una de ellas goza de características, funciones y elementos metodológicos propios. ¿Gamificación? ¿Juegos serios? ¿Aprendizaje Basado en Juegos? Ante esta amalgama de posibilidades, las siguientes líneas se presentan a modo de hoja de ruta que ayude a transitar por la senda del juego educativo, para lo (...) que, a su vez, se acompaña esta fundamentación teórica con un ejemplo didáctico de ABJ -editado como juego de mesa bajo la denominación “Catedral 1221”- concebido y diseñado con la finalidad de promover y facilitar el estudio de la Edad Media en la Educación Secundaria Obligatoria. Su aplicación con éxito en las aulas permite aportar orientaciones didácticas al respecto y extraer conclusiones relativas a la conveniencia y validez académica del juego en el marco de la enseñanza reglada. Psychosocial work factors are implicated in the development of stress and job satisfaction. This relationship has been scarcely studied in so-called singular activities, as is the case of professional drivers. This cross-sectional study of 601 professional drivers assesses psychosocial risks and job satisfaction using Copenhagen Psychosocial Questionnaire and Overall Job Satisfaction questionnaire models. The values of the psychosocial scales of professional drivers were compared with thresholds values of the Spanish working population. The relationships of the psychosocial scales with the level (...) of job satisfaction were examined using logistic regression models, adjusted for age, gender, length of driving license and years of experience. In general, professional drivers have an unfavorable psychosocial environment compared to the average Spanish workers. The relationship between psychosocial scales and job satisfaction is observed, with the most influential variables being the meaning and development of work, integration in the company, social relations, esteem and level of psychological demands. In this essay, through the concepts of cosmotechnics and technodiversity proposed by Yuk Hui, I present an exploratory sketch regarding the search for a Mesoamerican cosmotechnics from the perspective of the deep relationship that pre-Hispanic cultures have maintained with maize since ancient times. I consider that this relationship expresses a particular Mesoamerican cosmotechnics that—in Hui’s terms—manages to unify “the cosmic order and the moral order through technical activities” in these societies, even to the present day. Similarly, I argue that the (...) biological, agricultural, and gastronomic techniques—such as the milpa, chinampas, and nixtamalization—which have historically been woven around maize are an example of technodiversity that has persisted and withstood the onslaught of the capitalist logic. Finally, I affirm that this cosmotechnics has the potential to be configured as a cosmopolitics that must first overcome the obstacles of nationalist and identity discourses that became prevalent in post-revolutionary Mexico through the indigenist turn, and that are currently configured around the defence of traditional maize against the attempts to introduce its transgenic equivalent in recent decades. Este artículo quisiera introducir al corazón de «la cosa misma». Esta «cosa» no es aquí el sistema hegeliano propiamente en su totalidad. Ello sería pretencioso. Se trata más bien de la estructura de este sistema, es decir de la forma especulativa que determina el desarrollo y el ordenamiento de su contenido y permite captar, en su coherencia específica, las distintas obras donde se expone la sistemática hegeliana. Estas obras son principalmente la Fenomenología del espíritu, la Enciclopedia de las ciencias filosóficas (...) y los diversos Cursos de Berlín. En las obras restantes encontramos todavía la Ciencia de la lógica –que es el despliegue detallado de lo que en forma abreviada encontramos en la lógica de la Enciclopedia– y los Principios de la filosofía del derecho, que constituyen una elaboración más profunda de la parte consagrada al espíritu objetivo en la Enciclopedia. El ocho de febrero de 2013, a los ochenta y ocho años, falleció en Madrid el filósofo José Gómez Caffarena, pensador que no merece que caiga en el olvido. Su obra supuso un gran impulso modernizador en el debate filosófico español. Impulso que aún tiene gran recorrido, sobre todo en lo que afecta a la filosofía práctica, tan central en la actualidad por los retos que nos plantean nuestras complejas sociedades y el espectacular desarrollo de la tecnociencia. De la admiración (...) y el horror a la acción y la esperanza. Antropología y ética de José Gómez Caffarena es el título de la obra en la que realizo una lectura del pensamiento del autor madrileño desde las problemáticas contemporáneas al ponerlo en diálogo con las filosofías más representativas del siglo XX-XXI, como: el posmodernismo, el estructuralismo o el neo-positivismo. El presente artículo da una visión genérica, aunque esperamos lo suficientemente profunda y comprensible, del proyecto ético que encierra la compleja filosofía caffareniana. (shrink)

IntroductionThe prefrontal cortex plays a crucial role in cognition, particularly in executive functions. Cortical reactivity measured with Transcranial Magnetic Stimulation combined with Electroencephalography is altered in pathological conditions, and it may also be a marker of cognitive status in middle-aged adults. In this study, we investigated the associations between cognitive measures and TMS evoked EEG reactivity and explored whether the effects of this relationship were related to neurofilament light chain levels, a marker of neuroaxonal damage.MethodsFifty two healthy middle-aged adults from (...) the Barcelona Brain Health Initiative cohort underwent TMS-EEG, a comprehensive neuropsychological assessment, and a blood test for NfL levels. Global and Local Mean-Field Power, two measures of cortical reactivity, were quantified after left prefrontal cortex stimulation, and cognition was set as the outcome of the regression analysis. The left inferior parietal lobe was used as a control stimulation condition.ResultsLocal reactivity was significantly associated with working memory and reasoning only after L-PFC stimulation. No associations were found between NfL and cognition. These specific associations were independent of the status of neuroaxonal damage indexed by the NfL biomarker and remained after adjusting for age, biological sex, and education.ConclusionOur results demonstrate that TMS evoked EEG reactivity at the L-PFC, but not the L-IPL, is related to the cognitive status of middle-aged individuals and independent of NfL levels, and may become a valuable biomarker of frontal lobe-associated cognitive function. We propose a revision operator on a stratified belief base, i.e., a belief base that stores beliefs in different strata corresponding to the value an agent assigns to these beliefs. Furthermore, the operator will be defined as to perform the revision in such a way that information is never lost upon revision but stored in a stratum or layer containing information perceived as having a lower value. In this manner, if the revision of one layer leads to the rejection of (...) some information to maintain consistency, instead of being withdrawn it will be kept and introduced in a different layer with lower value. Throughout this development we will follow the principle of minimal change, being one of the important principles proposed in belief change theory, particularly emphasized in the AGM model. Regarding the reasoning part from the stratified belief base, the agent will obtain the inferences using an argumentative formalism. Thus, the argumentation framework will decide which information prevails when sentences of different layers are used for entailing conflicting beliefs. We will also illustrate how inferences are changed and how the status of arguments can be modified after a revision process. (shrink)

Este artículo es un estudio comparativo de la manera en que Aristóteles y Alexis de Tocqueville conciben a la familia dentro del contexto de la democracia antigua y moderna, respectivamente. Se elabora un recorrido por la institución de la familia y el matrimonio en Grecia y Roma, y sus vinculaciones con las ideas políticas de esas civilizaciones. Igualmente, se contrasta el entendimiento antiguo de la democracia con el de Tocqueville, y se analiza la vinculación que éste estableció entre el hogar (...) y la esfera pública en las democracias modernas.Palabras llave: Aristóteles; Alexis de Tocqueville; democracia antigua; democracia moderna; familia.This article is a comparative study of the way Aristotle and Alexis de Tocqueville conceive the institution of the family within the context of ancient and modern democracy, respectively. A survey through the institution of family and marriage in Greece and Rome is made, and their links with the political ideas of those civilizations. In what follows I seek to answer the question on whether it is possible to integrate two different lines of research on human rationality: on the one hand, some philosophical lines of research of a cognitivist nature, and, on the other, lines of research on the logical reasoning of human agents and normative criteria. My answer to such questioning will be affirmative. To defend my point, I shall proceed as follows: first, in sec. 2 I offer the antecedents and characteristics (...) of the cognitivist notion of “intelligence” that has greater acceptance today, the general theory of intelligence, also known as the g factor. Throughout sec. 3 I present the elements thanks to which it has been considered that although g factor manages to satisfactorily evaluate the phenomenon of intelligence, it ignores relevant characteristics from the perspective of what rationality has been considered to be. Then, in sec. 4, I present some notions of rationality available in literature on the philosophy of logic, and I evaluate what are the distinctive elements of each of these characterizations. In sec. 5, I defend that it is possible to improve our understanding of cognitive styles from the elements of the philosophy of logic exposed in section four. (shrink)
